What we collect, how we use it, and the choices you have.

Phoneware, Inc. (“Phoneware,” “we,” or “us”) respects your privacy. This policy explains what information we collect when you visit our website, use our communications services, or use our mobile and desktop apps, how we use and share it, and the choices and rights you have. It applies to our customers, the people who use accounts we provide, and visitors to our site. By purchasing, subscribing to, or using Phoneware services or website, you agree to this policy.

Information we collect

Information you give us — your name, business name, email, phone number, service and billing address, and payment details when you request a quote, place an order, or contact support.

Information created by using the service — records needed to route, deliver, bill, and support your communications, such as numbers dialed, call and message times and duration, features used, voicemail and (where enabled) recordings and transcriptions, and configuration data.

Information from our apps — when you use the Phoneware mobility, softphone, or fax apps, we collect your number and basic device information (operating system and device model) to deliver the service. Some features request device permissions: the camera to capture a profile photo, your photo library to attach files to cloud fax or set a profile photo, and push notifications for call and message alerts. We use these only for the feature you invoke, and you can manage or revoke each permission in your device settings.

Information collected automatically — when you visit our website, basic technical data such as IP address, device and browser type, and pages viewed, through cookies and similar technologies.

Aggregate and de-identified information — we also work with data from which individual identities have been removed to understand usage trends and improve our services. Aggregate information is not personally identifiable.

Customer Proprietary Network Information (CPNI)

As a communications provider, some of the information we hold is “Customer Proprietary Network Information” (CPNI) under federal law, information about the type, quantity, destination, and technical configuration of the services you use. We protect CPNI and do not use, disclose, or permit access to it except to provide and support your service, as you authorize, or as required by law. We do not sell CPNI.

Federal law lets us use your CPNI within Phoneware and with our authorized agents to offer you products and services that may fit your needs. You may restrict this use for our own marketing at any time by contacting us. Opting out will not affect the services you already have, and you have a right, and we have a duty, to protect the confidentiality of your CPNI.

How we use information

We use information to provide and operate the service; set up, configure, and support your account; deliver, route, and bill for usage; secure the network and prevent fraud and abuse; meet legal, tax, and regulatory obligations (including E911 and messaging rules); communicate with you about your account; and improve our products. We do not sell your personal information, and we do not use the content of your communications for advertising.

How we share information

We share information only as needed to run the service or as the law requires: with vendors and subprocessors who process it on our behalf under contract (for example, carriers and interconnection partners, hosting and platform providers, messaging, recording, and fax platforms, and payment processors); with your authorized administrators; to comply with legal process or protect rights and safety; and in connection with a merger or sale of the business, subject to this policy. We do not share mobile opt-in or messaging consent data with third parties for their own marketing.

Emergency calls. When you dial 911, we provide the location and callback information on file to the public safety answering point and emergency responders so they can assist you. Keeping your registered service address current is essential; see our E911 Disclosure.

Cookies & analytics

Our website uses cookies and similar technologies to keep the site working, remember preferences, and understand site usage through aggregate analytics. You can control cookies through your browser; disabling some may affect how the site works. Our site does not currently respond to browser “Do Not Track” signals, because there is no common standard for how to interpret them.

Data retention

We keep information while your account is active and as needed to provide the service, then retain it as required to meet legal, tax, accounting, and regulatory obligations or to resolve disputes. Retention periods vary by data type; call detail and billing records, for instance, are kept as long as regulations require.

Security

We use administrative, technical, and physical safeguards designed to protect your information, including access controls and encryption in transit where appropriate. We limit access to personal information and CPNI to staff and contractors who need it to serve you. No system is perfectly secure, but we work to protect your data and to respond promptly if an incident occurs.

Your rights & choices

You may ask us to access, correct, or delete personal information we hold about you, subject to legal and contractual limits, and we will respond as required by law. You can opt out of marketing email at any time, and stop text messages by replying STOP. Depending on where you live, you may have additional rights, including under the California Consumer Privacy Act as amended by the CPRA, to know, access, correct, delete, and limit the sharing of your personal information, and to not be discriminated against for exercising them. Because we do not sell personal information or share it for cross-context behavioral advertising, there is nothing to opt out of on that front. To make a request, contact us below; we will verify and respond as required by law.

Testimonials

With your consent, we may display a customer name, logo, or testimonial on our website. If you would like a testimonial removed, or wish to give or withdraw consent, contact us and we will take care of it.

Children

Our services are intended for businesses and are not directed to children under 13, and we do not knowingly collect personal information from them.

Changes to this policy

We may update this policy from time to time. We will post the current version here and update the date above when we make material changes.
